In response to the disappointing results of many regulatory or public investment approaches to watershed management, payments for environmental services has emerged as a new mechanism to maintain socially optimal environmental services by compensating people for the services they provide. However, without adequate understanding of stakeholders’ willingness to modify or maintain land use or water resource decisions, market-based mechanisms may prove to be unsustainable, with uncertain social and environmental outcomes. Negotiating resource use patterns is a process that requires an understanding of the type, level and duration of incentives for stakeholders to co-operate meaningfully. In this paper, we describe a negotiation support framework that has been developed from the literature and field experiences in Costa Rica and India. The framework then serves to critically examine a case study from each country to draw empirical lessons from the inherently political and contested process of watershed management.

Climate change has exacerbated concerns about water security. The authors stress the need for countries in basins where populations are growing to anticipate the water shortage implications for food production. The paper analyses the future status of the interdependence among riparian states in four semi-arid transnational basins under the climate change SRES A2 scenario and projected population growth with a focus on the potential for rainfed agriculture on current croplands and the requirements for irrigation water. Increasing water interdependence among basin states requires institutional preparedness and water sharing arrangements.We conclude that the inclusion of long-term trends in the design of water sharing agreements will improve their robustness to cope with change and mitigate the potential risk of conflict.

Water practitioners are increasingly called upon to negotiate workable agreements about how to best use, manage and care for water resources. NEGOTIATE makes the case for constructive engagement and cooperative forms of negotiation in dealing with complex water issues. It unpacks constructive approaches such as Multi-Stakeholder Platforms (MSPs) and consensus building, and finally focuses on the diversity of agreements which can be produced to regulate or encourage fairer and more effective water allocation and use.

Water is one natural resource whose management is especially susceptible to uncertainties, many of which are being exasperated by climate change. Some of these uncertainties originate from knowledge deficits in physical conditions while others relate to behavioral and social variability related to water supply and use. However, to our knowledge no quantitative analysis of how uncertainties have been translated into transboundary water treaty structures exists. The present paper partially fills this gap through an examination of how uncertainty has been reflected in basin specific transboundary treaties and how that reflection has changed over the last century. While we could identify only minor trends in the frequency with which uncertainties are mentioned in treaties, we did find two clear patterns in the strategies adopted to deal with them. First, treaties seem to adopt a portfolio approach that spreads the dangers of uncertainty by concurrently including several management strategies simultaneously. Second, there is a trend towards more openended strategies in recent decades, rather than hard codification of rules as had earlier been more common.
